If you're facing a third DWI charge, the consequences can be life-altering. Potential jail time, hefty fines and a suspended license can disrupt your career, financial security and overall well-being. Understanding the enhanced penalties for a third DWI and your legal options is crucial for navigating this challenging situation.

Here's what you should know about facing a third DWI offense.

A third DWI conviction in Texas is classified as a felony, carrying far harsher penalties than a first or second offense. These penalties can include:

Mandatory jail time: Unlike first or second DWIs, a third conviction requires a minimum of two years in state prison, with a potential maximum sentence of ten years.

Steeper fines: You can expect fines ranging from $2,000 to $10,000, significantly higher than those for previous offenses. Additional court costs and fees can further strain your finances.

Driver's license suspension: Your driver's license will be suspended for a minimum of 180 days, with the possibility of a two-year suspension. This can significantly impact your ability to work, run errands and maintain a normal routine.

These penalties can cause significant damage to your life and livelihood. In some cases, you could face job loss and other challenges.

Building a strong defense strategy

Facing a third DWI charge doesn't mean there's no hope. An experienced Houston criminal defense attorney can help you explore various options to minimize the impact on your life. This may involve:

Challenging the evidence: We will meticulously analyze the police report, breathalyzer results and other evidence to identify any potential inaccuracies or procedural errors that could weaken the prosecution's case.

Negotiating plea bargains: In some cases, negotiating a plea bargain that reduces the charges or sentence may be a viable option. Having a skilled attorney on your side ensures you receive the best possible deal.

Mitigating factors: Our lawyers will explore factors such as a clean criminal record or participation in rehabilitation programs that may influence the judge's decision and potentially lead to a more lenient sentence.

Third DWI charges are serious, but they don't have to define your future. By seeking guidance from a qualified Houston criminal defense attorney, you can explore your legal options and fight for the best possible outcome.

Many different issues can lead to a traffic stop. If a Texas police officer witnesses your vehicle veering over the yellow line, for instance, chances are, you will soon see flashing red and blue lights in your rearview mirror, signaling you to pull over. Events often unfold rather quickly. One minute, you’re driving home from a night out with friends, and the next, you’re in the back of a police car heading to a county jail for suspected DWI.

A single traffic stop can have both immediate and far-reaching implications in your daily life, especially if you incur a driver’s license suspension because of DWI charges. A suspension might mean that you have no way to get to work. This can place your job at risk, which can quickly lead to financial crisis, especially if you are the primary income earner in your household.

Good news -- you might qualify for an occupational license after a DWI

Provided that the court did not suspend your license due to unpaid child support or a medical condition, you might be eligible for an occupational driver’s license following a DWI arrest. This is a license that enables you to lawfully operate a motor vehicle for specific reasons. Such reasons include going to school, work or essential household duties like grocery shopping.

You must file a petition to request an occupational driver’s license following a DWI arrest. You’ll typically have several options as to where to submit your petition, including the original court of jurisdiction where your arrest took place, as well as a Justice of the Peace or district court in your residential area. Be aware, however, that if the court issues an order to grant your request, you must take further action to obtain the occupational driver’s license.

Send court order and required documentation to the Department of Public Safety

In addition to the court order approving your request for an occupational license, you must also submit application fees, a financial responsibility insurance certificate and several other important documents to the Department of Public Safety. Only after you have met all requirements will the department issue your occupational driver’s license. It’s worth noting that this system is set up for non-commercial driving licenses only.

If the court has revoked or suspended your commercial driver’s license (CDL) because of DWI or for any other reason, you are not eligible for an occupational license to temporarily replace the CDL. An occupational license is only issued for operation of non-commercial vehicles. If you’re unsure whether you qualify for an occupational license in Texas, you may reach out for guidance from someone who is knowledgeable about drunk driving laws in this state.

Driving while intoxicated (DWI) is a serious offense, and having multiple DWIs can lead to severe consequences. If you face the legal aftermath of more than one DWI in Texas, it is crucial to understand the potential repercussions. Here, we aim to shed light on the consequences you may encounter.

Legal ramifications

Texas takes a tough stance on DWI offenses, especially for repeated offenses. If you have multiple DWIs, you could face increased penalties, including longer jail sentences, higher fines, and extended probation periods.

1. License suspension

One of the immediate consequences of multiple DWIs is the risk of losing your driver's license. The Texas Department of Public Safety (DPS) may suspend your license for an extended period, adding a challenge to your life because, if you are like most people, you use a vehicle to drive to school, work and everywhere else.

2. Ignition interlock device

In Texas, individuals with multiple DWIs may be required to install an Ignition Interlock Device (IID) in their vehicles. This device requires the driver to pass a breathalyzer test before starting their car.

If your local authorities install an IID in your car, you might feel inconvenienced every time you have to get on the road, and you will be constantly reminded of the legal consequences of your actions.

3. Impact on education and employment

Multiple DWIs can have a lasting impact on your education and career opportunities. College admissions and job applications often require background checks and a history of DWIs can be a red flag for potential employers and academic institutions.

The consequences of having multiple DWIs in Texas are severe and can affect various aspects of your life. It is crucial for everyone to understand the potential legal, personal, and educational ramifications of making such choices. Responsible and sober driving is not only a legal obligation but also a commitment to ensuring a safe and promising future.

Imagine that you’re driving along a Texas highway, and you glance in your rearview mirror. The first thing you see are flashing lights atop a police car. You pull over. The officer approaches and, after offering a brief greeting, asks, “Have you had any alcohol to drink tonight?” What should you do? Do you have to answer such questions during a DWI stop?

If a police officer is asking a question like that, it’s clear that he or she suspects you of drunk driving. The officer might even say, “Please step out of your vehicle.” There are several things you must do during a traffic stop, and one of them is to exit the vehicle if the officer instructs you to do so. However, you do not have to answer questions about alcohol.

License, insurance and registration are all you need to show in a DWI stop

Whether an officer has pulled you over for speeding, a broken taillight or suspected drunk driving, the patrol officer making the stop will ask to see your driver’s license, proof of insurance and vehicle registration. You must produce these documents. You must also confirm your name and address. Anything beyond that (meaning other questions) is not obligatory.

A police officer can ask anything he or she wants during a DWI stop, such as where you were earlier or who you were with. The officer might ask questions in such a way that it appears he or she has already assumed, like asking, “How much have you had to drink?” rather than “Were you drinking?” No matter what the question is, you do not have to answer it. You may invoke your right to remain silent under the Fifth Amendment of the U.S. Constitution.

Invoking Fifth Amendment rights during a DWI stop

When a Texas police officer detains you under suspicion of DWI, he or she immediately begins trying to establish probable cause to make an arrest. If you admit that you consumed alcohol before getting behind the wheel, it will compel the officer to try even harder to establish probable cause to make an arrest. You also don’t want to lie if you did imbibe before driving.

A driver may simply state, “I am invoking my Fifth Amendment right to remain silent.” You can also say, “I choose to not answer the question.” Silence is in no way an admission of guilt. If you choose to answer the officer’s question about alcohol, be aware that whatever you say can and will be used to try to incriminate you in court if you wind up facing DWI charges in Texas.

If Texas police take you into custody, either during a traffic stop or after paying a visit to your home or in other circumstances, you no doubt might feel anxious or even afraid, especially if you’ve never encountered legal problems prior to that moment. If you wind up facing charges, the opportunity to refute them in court is a guarantee. Hiring a criminal defense attorney increases your chances of obtaining a positive outcome.

There are no rules requiring you to hire a criminal defense attorney. If you choose to do so, you can represent yourself in court. Before you make such a decision, there are several factors to consider.

A criminal defense attorney is worth the investment

An experienced attorney understands the criminal justice system and knows how to resolve a case in the swiftest, most economically feasible manner possible. An attorney also knows how to poke holes in the prosecution’s case, which might help you stay out of jail. In the long run, therefore, the benefits of hiring an attorney far outweigh the cost, especially because you might get results quicker, which means less time off work, which means you might not lose your job.

An attorney is well-versed in the Fourth and Fifth Amendments

Interrogation following an arrest can be an unsettling experience. The Fourth Amendment of the U.S. Constitution protects you against unlawful searches and seizures. The Fifth Amendment protects you against self-incrimination, which means you have a right to remain silent when police ask you questions.

With an attorney present to advocate on your behalf, the interrogation process will be much less stressful. Your attorney can advise you before you speak so that you do not answer questions in a way that constitutes an admission of guilt or otherwise places you at risk for self-incrimination.

Should you accept a plea bargain?

If you’re representing yourself, you might not know whether it’s better to plead guilty in exchange for a plea bargain or to plead not guilty and decline the plea offer. A criminal defense attorney can review the offer and explain to you why one option might be better than another.

Facing charges in Texas for DUI, drug possession, unlawful possession of a firearm, theft, assault or any other crime means that you might incur severe penalties if the court hands down a conviction. You can boost your chances of a favorable outcome by allowing a criminal defense attorney to speak and act on your behalf throughout proceedings.

This was one of several reforms that came to be through a correctional treatment and diversion plan throughout the state. In decades prior to these reforms, there was an approximate total of 150,000 inmates housed in state prisons.

Former Governor Ricky Perry activated a bipartisan reform of the Texas criminal justice system. At the time, state prisons were full, yet the governor learned that at least 17,000 or more inmates could enter the system that year. Data shows that the mandates ultimately saved taxpayers millions of dollars and reduced the prison population.

Similar reforms since that time have helped pregnant women convicted of crimes in Texas

If you are one of many pregnant women who have had their cases adjudicated through the Texas criminal justice system, you’ll no doubt be glad to know that mandates instituted in 2019 have made state prisons a lot safer for expectant mothers. The following list shows several mandates that are currently in place to protect pregnant women who are serving time in jail:

If you are an expectant mother residing in a Texas prison, law enforcement officers or guards cannot place you in shackles.

You must have access to educational materials that can help you prepare for childbirth and motherhood.

If you undergo a strip search, a female guard must administer it.

After giving birth, for as long as your incarceration, you may see your child (and any other child you have who is under age 18) a minimum of two times per week.

In recent years, these and other reforms have reportedly had a positive effect on communities throughout the state. The overall crime rate in Texas has greatly decreased, and the prison population has been reduced so much that numerous prisons have been closed.

Understand your criminal defense options and know how to defend your rights

While most people would agree that there have been significant improvements made in the Texas criminal justice system, no one wants to wind up in jail. An arrest and charge with a crime doesn’t necessarily mean you will face a conviction or serve time in prison if a conviction is handed down.

Regardless of the events that led to your arrest, as a defendant with an active docket sheet in a Texas court, you have an opportunity to exercise any options or strategies available to try to mitigate your circumstances. You have a right to seek counsel and a right to challenge evidence or request a case dismissal if a personal rights violation took place leading up to, during or following your arrest.

However, another designation is nothing to brag about. The Lone Star State is statistically the fifth worst state for drunk driving, based on data collected from 2020.

Drunk driving remains a problem

A study conducted by Zutobi, a resource for online driver education, gave Texas a “severity score” of 64.4 percent. Factors that determined the score include:

The total number of all DUI deaths

DUI deaths per 100,000 drivers

Drunk driving arrests for every 100,000 motor vehicle operators

DUI fatalities factoring in all fatal road accidents

Texas also saw a rise of 12.2 percent in driving while intoxicated deaths. Even more alarming is that the state is first in the lowest arrest rates for drunk drivers out of the entire top five. States ranking higher include Wyoming, Montana, and North and South Dakota.

States ranking in the more coveted “last place” category include New York, New Jersey, Delaware, Massachusetts, and Hawaii.

National statistics revealed that men are four times more like to cause a fatal DUI accident compared to women. Additionally, thirty percent of traffic-related deaths involved drunk driving, an increase of nearly 15 percent from the previous year (2019). The National Institute of Alcohol Abuse and Alcoholism cited the pandemic-driven increase in alcohol purchases playing a role in that statistic.

Strict Lone Star State laws and consequences

Texas is well known as one of the states with harsh DUI penalties, including three other laws involving impaired driving. Those include ignition interlock devices, open containers, and child endangerment.

The flashing lights from a police car are the first indication of potential trouble. However, drunk driving tests that lead to an arrest do not mean that a conviction is automatic. A skilled and experienced DUI attorney with comprehensive knowledge of Texas law can be your best advocate in protecting your rights.
